Terms of Service

These Terms of Service ("Terms") govern your access to and use of the KAIROX Method coaching platform (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you confirm that you meet this requirement and that the information you provide about yourself is accurate.

2. The Service

KAIROX Method provides online coaching tools that may include personalized workout programs, nutrition plans, habit tracking, mindset content, progress logging, and direct messaging with your coach. The Service is delivered as a web application and a Progressive Web App.

3. Your account

• You are responsible for safeguarding your password and for any activity under your account.
• You agree to provide accurate information and to keep it up to date.
• You may not share your account credentials with anyone or use someone else's account.
• We may suspend or terminate your account if you breach these Terms.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Interfere with or disrupt the Service's integrity, security, or performance.
• Attempt to reverse engineer, scrape, or copy any part of the Service.
• Upload content you do not have rights to, or content that is harassing, abusive, or harmful.

5. Subscriptions, billing, and refunds

• Billing: Subscriptions are billed in advance through Stripe on the plan you select (monthly or quarterly).
• Auto-renewal: Subscriptions renew automatically at the end of each billing period unless cancelled.
• Cancellation: You can cancel at any time from the billing page in the app. Cancellation takes effect at the end of the current billing period; you keep access until then.
• Refunds: Payments are non-refundable except where required by law. Within the first 14 days after your initial subscription, EU/UK customers may have a right of withdrawal under consumer protection law; contact us to exercise it.
• Taxes: Prices may include applicable VAT or sales tax depending on your location.
• Price changes: We may change subscription pricing with at least 30 days' advance notice. Changes apply to the next billing cycle; you may cancel before then if you do not agree.

6. Health and fitness disclaimer

The Service provides general fitness, nutrition, and wellness content. It is not medical advice and is not a substitute for consultation with a qualified physician, dietitian, or mental-health professional. Before starting any new exercise program, diet, or wellness practice, consult a healthcare professional, particularly if you have any pre-existing condition, are pregnant or nursing, or take medication. Stop and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptom.

7. AI-generated content

Some workouts, meal plans, and other suggestions are generated by artificial intelligence based on the inputs you provide. AI suggestions are general guidance only, may contain errors, and are not personalized medical advice. Use your judgement and consult your coach or a healthcare professional before acting on them.

8. Intellectual property

• KAIROX Method, its software, design, content, brand, and trademarks are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use.
• You retain ownership of the content you upload (photos, journal entries, messages). By uploading content, you grant us a limited licence to store, display, and process it solely to operate the Service for you and your coach.

9. Privacy

Our handling of your personal data is described in the Privacy Policy, which is part of these Terms.

10. Limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising under these Terms is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law (including liability for death or personal injury caused by negligence, or for fraud).

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for material breach of these Terms or for prolonged inactivity. Sections that by their nature should survive termination (Intellectual property, Disclaimer, Limitation of liability, Governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. We will publish the updated version on this page with a new "Last updated" date. For material changes, we will notify you by email or via an in-app notice at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States of America, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.
